My employer mentioned that my job description is Senior Analyst in the application. Does that mean I have to be a Senior Analyst till the time I get GC ? Cant I take up another job like Architect ?

during stage 3, they require a birth certificate. what if I dont have a birth certificate? do they accept an affidavit from my parents with a domicile cerrtificate or not? i dont even have a school leaving certificate. please give me advices.

Hi, I have a H1B from company A stamped in my passport and it has been expired in sep 2005. I joined company B in march 2004 and I have their I-797 valis till Jan 2008. I am going to India to stamp it on the passport. Is their any issue with this ? I heard that if one is changing the comany, he/she has to stamp the H1B of the new company on the passport within 6 months or so. Please help.

Regarding the receipt notice of I-485: which is the difference between the receipt date, receipt number and receipt notice.....from my understanding....the receipt date is when your I-485 application hits Uscis and the receipt notice is when the Uscis is really opening your package and looking at it?
Is it safe to travel( with valid H1b) knowing that your file hits the Uscis...or you have to wait for the receipt notice( now with so many filers for July, is it true that Uscis will send the receipt notice very late, maybe months, I mean later than the June filers.)?
Is it safe to travel after you file for I-485 and before getting the receipt notice....hoping that the receipt will come after you returned to U.S?

My full 6 years of H-1B expires in Jan 2010. My labor will be filed in Jan 2009. I would like to go back to school full time on F-1 in Fall 09. At that time, I would still have 5 months of H-1B time remaining plus a priority date. After I graduate, find a job on a new OPT, would it be enough time to start a new GC processing, without having to go back home for a year?

I am on H1B visa and married to a mexican citizen for past 2 years. we both have been living in mexico for past 2 years ( i am working as an Expat). 4 years ago my wife was in US on a Tourist visa and attended community school to learn English. she left the country in 6 months but while re-entering she mentioned her going to school to the agent upon which they processed a expedited removal and put a 5 year ban. She will complete her 5 years in Feb 2012. We are going to have a baby soon and would like to move to US next year after her 5 years are complete. i want to apply for a H4 visa for my wife and my baby. Will her expedited removal cause a problem with H4 application? thanks in advance.

Funds were running out for the troops, and she had promised to protect them. The Memorial Day break loomed, and without the money President Bush would have a week to hammer her party for taking a vacation while the Pentagon scrambled to keep its soldiers fed.
Was she agonized over the situation? Sure, said Rep. Maurice D. Hinchey (D-N.Y.), who attended the meeting. But "we all feel that way," he added. "I feel that way, too. Are we going to just walk away now, or are we going to continue this process, to keep the pressure on?"
Yesterday's vote to fund the war through September was a historical rarity: the passage of a bill opposed by the speaker of the House and a majority of the speaker's party.
Two years ago to the day, then-Speaker J. Dennis Hastert (R-Ill.) violated the "Hastert rule" -- that only bills supported by a majority of the majority can come up -- by bringing up legislation to allow federal funding for stem cell research. The majority of the Republican majority opposed the law. He voted against it, but he knew it would never become law over President Bush's signature.
Over his objections and the opposition of most Republicans, Hastert did allow passage of campaign finance reform in 2002, but only because a petition drive was about to force the bill to the floor. The North American Free Trade Agreement passed in 1993, over the objections of most Democrats, who were then in the majority. But NAFTA did have the support of then-Speaker Thomas S. Foley (D-Wash.), as well as the Democratic president, Bill Clinton.
In contrast, the Iraq funding bill was not only opposed by the majority of House Democrats, it was also ardently opposed by the speaker and even the lawmaker who drafted it, Appropriations Committee Chairman David R. Obey (D-Wis.). And it is destined to become law.
"We don't relish bringing a package to the floor that we're not going to vote for," Obey conceded before last night's vote.
Pelosi's agonized decision put her in the company of Foley, who in 1991 brought to the floor the resolution authorizing the Persian Gulf War and then voted against it, and Thomas Brackett Reed, a speaker in the 1890s who voted against the annexation of Hawaii, and then against the Spanish-American War, but allowed both to go forward.
"To have the chairman and the speaker vote against a bill like this, I've never heard of it," Hastert said.
But while protesters outside the Capitol condemned what they saw as a capitulation, Democrats inside were remarkably understanding of their speaker's contortions.
Party leaders jury-rigged the votes yesterday to give all Democrats something to brag about. A parliamentary vote to bring the Iraq funding legislation to the floor included language demanding a showdown vote in September over further funding. A second vote allowed Democrats to vote in favor of funds for Gulf Coast hurricane recovery, agricultural drought relief and children's health insurance. Finally, the House got around to funding the war.
Republicans cried foul over what they saw as an abuse of the legislative system, but Democrats saw brilliance in the legerdemain. And with such contortions came more appreciation for the efforts Pelosi was making to fund the war in a fashion most palatable to angry Democrats.
"It was the responsible thing to do, and she's a responsible speaker," said Rep. Anna G. Eshoo (D-Calif.), who is personally close to Pelosi. "You can't just walk away."

I am currently on H1B through company A previously I was working for Company B before that was working for Company C.
I transferred my H1B from C->B->A, Because of current Economy now my employer(Company C) is saying that if I lose my current project at client location he is going to cancel my H1.
If that happens can I go back to B Or C company, as My previous companies never cancelled my H1.
Appreciate any help here.

My H1B expires in September and was filed under a different company name, but they are a successor in interest. so we were planning on amending the H1B when we file to extend. The problem now is - the beneficiary is in a new position AND as of September 1, 2009 the company has changed addresses.
A) In filling out the I-129 in Part 2, questions 2 and 5, what are the appropriate boxes to check?
I am afraid if we amend the current application, it won't also be extended and he will fall out of status.

1- new employment
2-continuance of previous approved employment
3-change in previously approved employment
4-new concurrent employment
5-change of employer
6- amended petition
B) Also, what documents, other than what we have, should be included in the filing?
We will file a new LCA with all updated information once we receive a certification of the current LCA and then withdraw it.

I need some good advice and facts...
My friend's H1-B extension is approved but the stamping (Mumbai consulate) might get denied due to a previous (dismissed) charge for driving with suspended license.
What are the options after that? Can he re-apply for the visa stamping again using the same H1-B approval petition? Can we appeal the decision since it document clearly states that the fine was paid?
Please advise.
